Terms of Service.
These terms govern your use of ExcBrand, an AI reputation service provided through excbrand.ai and app.excbrand.ai.

1. About these terms
These Terms of Service govern your use of ExcBrand, an AI reputation service operated by Athirium OÜ (the “Provider,” “we,” “us”). ExcBrand is provided through the websites at excbrand.ai and app.excbrand.ai. By accessing or using the service, you agree to these terms. If you do not agree, do not use the service.
2. Who may use the service
ExcBrand is an invite-only service. Access is provided through a seat that a company arranges on behalf of a named executive (a “Seat”). You may use the service only if you have been invited and hold an active Seat, and only for the executive it was provisioned for. You must be able to form a binding contract and must be acting in a professional capacity.
3. What the service does
ExcBrand measures and helps improve how the major AI engines (Claude, ChatGPT, Perplexity, and Gemini) and Google represent an executive, for their name and a small number of chosen topics. The service:
- monitors how these engines and Google answer when asked about the executive;
- prepares truthful corrections and content for the executive’s review;
- publishes or submits approved material on the executive’s behalf, only after approval; and
- reports progress through an executive portal and periodic summaries.
The service depends on third-party AI engines and search providers whose outputs we do not control. We measure and work to improve how they represent an executive, but we do not guarantee any specific engine output, ranking, score, or result.
4. Approvals and authorization
Nothing is published, submitted, or sent on an executive’s behalf without approval. When you use the service you may grant standing approval within defined guardrails so routine work can proceed, but sensitive items and external placements always require explicit, per-item approval. No content about you is published autonomously. You are responsible for the accuracy of the information you approve and for the instructions you give.
5. Truth-only and acceptable use
We operate a truth-only rule. We correct inaccurate or outdated claims and strengthen truthful, well-sourced information. We do not fabricate facts, invent citations, or engage in reputation laundering, and you agree not to ask us to. You agree not to use the service to mislead, to defame, to infringe the rights of others, or in any unlawful way. We may decline or halt any request that conflicts with this section.
6. Content and submission targets
As part of the service we may submit an executive’s professional profile to relevant third-party destinations, including The Crest (thecrest.ai), a curated executive-profile service, where doing so supports the executive’s accurate representation. Any such submission uses only the executive’s professional information and follows the approval rules in Section 4. Third-party destinations have their own terms, which govern the content once submitted.
7. Intellectual property
The Provider owns the ExcBrand platform, software, methods, scoring methodology, and all related intellectual property. The executive and their company own their underlying professional record and the approved content published on their behalf. Each party grants the other the licenses reasonably needed to deliver and receive the service. Nothing in these terms transfers ownership of the platform to you.
8. Service availability
We aim to keep the service available on a commercially reasonable basis. We may modify, suspend, or discontinue features, perform maintenance, or impose reasonable limits to protect the service. We are not liable for interruptions outside our reasonable control.
9. Disclaimers
The service is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose and non-infringement. We do not warrant that AI engines or search providers will represent an executive in any particular way, or that any measurement, score, or projection will be achieved. Measurements reflect third-party outputs at a point in time and can change.
10. Limitation of liability
To the maximum extent permitted by law, the Provider is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the fees paid for the relevant Seat in the twelve months before the event giving rise to the liability. Nothing in these terms limits liability that cannot be limited by law.
11. Term and termination
These terms apply for as long as you use the service. The commercial term of a Seat is set in the applicable service agreement between the Provider and the company. We may suspend or terminate access for breach of these terms, for unlawful use, or as required by law. On termination, monitoring stops, the executive may request an export of their canonical record, and owned published assets remain with the executive as described in the service agreement.
12. Data protection
Our handling of personal data is described in the Privacy Policy at /privacy, which forms part of these terms. Where the Provider processes personal data on behalf of a company, a data processing agreement governs that processing.
13. Changes to these terms
We may update these terms from time to time. When we make material changes we will update the “Last updated” date and, where appropriate, notify affected users. Continued use of the service after changes take effect means you accept the updated terms.
14. Governing law
These terms are governed by the laws of Estonia, without regard to conflict-of-law rules. The courts of that jurisdiction have exclusive jurisdiction over disputes, subject to any mandatory consumer or data-protection rights you have under local law.
